Privacy Policy

This privacy policy applies to App Dishnity, the website of Dishnity, as well as other offers of Dishnity that refer to this privacy policy.

Introduction

The mobile app Dishnity (hereinafter: “Dishnity app”) is a platform for sharing recipes (hereinafter: “Dishnity”).

Dishnity relies on a freemium model. Thus, registration or profile creation (hereinafter: “user profile”) is free of charge for a user of the platform. After registration, other recipes can be swiped to the left or right, other people can be followed and you can create your personal recipe book. In addition, a premium service with costs is offered, which enables the user to use further functions.

Dishnity is a platform for sharing recipes. Registration is possible from the age of 18.

The collection, processing and use of your data is carried out according to the provisions of the Telemedia Act (TMG) and the Data Protection Act, in particular the Federal Data Protection Act (BDSG) and the Basic Data Protection Ordinance (DSGVO).

This document explains how we handle personal data.
The DSGVO defines personal data as follows:

“personal data” shall mean any information relating to an identified or identifiable natural person (hereinafter referred to as “data subject”); an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person (DSGVO Chapter 1, Art. 4)
Furthermore, this document explains which data is collected, stored and processed and how the protection and security of personal data is guaranteed.

1 How is the data processed when downloading the Dishnity app?

1.1 Download of the Dishnity app

To download our App from an AppStore (e.g. Google Play, Apple App Store), you must first create a user account with the respective App Store providers and conclude a corresponding user agreement with them. Dishnity has no influence on this. When downloading and installing the App Dishnity, the necessary information is transferred to the respective App Store, in particular your user name, your e-mail address and the customer number of your account, the time of the download, payment information and the individual device identification number. Dishnity is not responsible for this data collection and we have no influence on it. Dishnity will only process the data provided as far as this is necessary on the mobile device. Beyond that, the data will not be stored further.

1.2 Installation and Authorizations

In order to provide the services provided by Dishnity app and to ensure the technical functionality of the Dishnity app, Dishnity requires various access options and information.

Permission for access to individual functions and information is requested either during installation or use of the app and includes, among other things, location, notifications and mobile data. Some of the granted access permissions can be viewed and revoked under the settings of the mobile device, although limited access permissions may have a negative effect on the functionality of the app.

2 How is data processed when visiting the Dishnity website?

In server log files, the provider of the website automatically collects and stores information which your browser automatically transmits to us. These are:

  • Visited page on our domain
  • Date and time of the server request
  • Browser type and version
  • Operating system in use
  • Referrer URL
  • Host name of the accessing computer
  • IP address

This data is not merged with other data sources. The basis for data processing is Art. 6 para. 1 letter b DSGVO, which permits the processing of data for the fulfilment of a contract or pre-contractual measures.

3 What data is processed after profiling?

Dishnity uses the personal data listed in this section exclusively for the purpose of the user relationship and out of the legitimate interest of Dishnity in accordance with the contents of this privacy policy.

The legal basis for the processing of the personal data listed in this section is (if not explicitly referenced) Art. 6 I lit. b) EU-DSGVO or Art. 6 I lit. f) EU-DSGVO.

3.1 Profile data

3.1.1 Mandatory information

When creating the user profile, the following information must be provided:

  • e-mail address
  • Password
  • Nickname (pseudonym)
  • Date of birth

These data are collected, processed and used for the use of Dishnity. Furthermore, this information is used for authentication, age verification, personalisation of the profile, display of other suitable user profiles, addressing and in pseudonymous form for advertising purposes (see also item 4).

This data is deleted when you delete your user account.

3.1.2 Voluntary information

Within the Dishnity app, the user can make further voluntary entries and modify his search settings. In this way, the user can improve his or her user experience. This information is voluntary and can be viewed, entered, changed or deleted in the profile under Settings and Edit Profile.

This data is collected, processed and used by us for the use of the app. In addition, this voluntary data is visible to other logged-in users within Dishnity, but the user is free to delete or change this data at any time in the settings or edit profile within the user profile. In addition, this data may also be processed and used for advertising purposes (see details on advertising under item 4).

This data will be deleted when you delete your user account.

3.2 Usage data

3.2.1 IP addresses

For security and verification purposes, the IP addresses of users are recorded for security and verification purposes to prevent misuse of the service.

This data is stored in full for up to 90 days and is deleted when your profile is deleted.

In addition, the IP address is passed on to advertising partners when advertising is displayed, see 4. This passing on of data cannot be prevented due to technical reasons.

3.2.2 Device data

When you use Dishnity, we receive information from you about the device you are using, such as the manufacturer, operating system, advertising ID. This information is used to prevent misuse of the service.

This data is stored completely for up to 90 days and is deleted when your profile is deleted.

3.2.3 Event data

When you use Dishnity, we receive information from you about your activities (so-called events) in the app, such as when you “like” a user or send them a message.

This data is stored, processed and used by us for the purpose of using the App, in particular to improve your user experience and to prevent abuse of the service.

This data is deleted when you delete your user account.

3.3 Payment data

External payment providers are used when making in-app purchases via Dishnity, purchasing Coins or our paid premium service. Dishnity does not collect any payment data during the purchase; the entry and processing of payment data is carried out directly by the payment providers. Technical data (including the transaction ID) are exchanged between Dishnity and the payment providers for the purpose of performance and validation of the payment.

This data will be stored until your user account is deleted or until the data is no longer subject to any tax, commercial or other legal retention obligations.

The legal basis for this processing of personal data is Art. 6 I lit. b) EU-DSGVO.

4 How will my data be used by Dishnity for advertising purposes?

Dishnity uses a freemium model, i.e. Dishnity can be used by any user in a basic version without paying a fee. To finance the platform, however, the free version displays advertising which is provided by external service providers.

4.1 What data is used for advertising purposes and who receives data?

Dishnity uses advertising from third parties, which can also be personalised advertising. Only data which the user himself has made public as well as device and network data (pseudonymised) are used. Dishnity does not pass on any data to advertising partners which allow a direct conclusion to the exact person (such as name, e-mail address, profile picture or similar data).

When personalised advertising is placed, the respective external advertising service provider receives the following pseudonymised data (hereinafter: the “transmission data”):

  • Advertiser ID
  • The approximate location published by the user
  • Technical data about the terminal device
  • Data on the advertisements placed

The transmission data is passed on to the following categories of recipients for the purposes listed below

  • Operators of advertising networks, especially AdMob
  • Operators of tracking services
  • affiliate networks
  • customer relationship service provider
  • Other sales & marketing partners

The user can revoke the processing of this data in the device settings at any time with effect for the future. The Advertising ID can be deleted at any time in the device settings (“Reset Ad-ID”). A new identification number will be created.

The contractual partners have undertaken to process the data in accordance with the high criteria of the European Union for advertising purposes. The recipients of the data are partly located outside the European Union. The transfer by Dishnity will only take place if the recipient has provided suitable guarantees that an adequate level of protection exists.

The transmission data is transferred to the following countries:

  • USA (EU-US Privacy Shield Agreement or EU standard contractual clauses)
  • Israel (Adequate level of data protection recognised by EU Commission)

The Privacy Shield Agreement, the Adequacy Decision and the EU standard contractual clauses are available on the website of the EU Commission (https://ec.europa.eu/info/law/law-topic/data-protection_en).

The processing and transmission of the aforementioned data is based on the fulfilment of the contract with the user (Art. 6 I lit. b DSGVO in conjunction with No. 11.2. of the Dishnity GTC), on his consent (Art. 6 I lit. a DSGVO) and on the legitimate interest of Dishnity pursuant to Art. 6 I lit. f DSGVO.

When using the app in the free version, the user agrees to the transfer of his data to the above reception categories.

Our website uses cookies. These are small text files that your web browser stores on your end device. Cookies help us to make our offer more user-friendly, effective and safer.

Our website uses functions of the web analysis service Google Analytics. The provider of the web analytics service is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses “cookies.” These are small text files that your web browser stores on your end device and enable an analysis of website usage. Information generated by cookies about your use of our website is transmitted to a Google server and stored there. Server location is usually the USA.

The setting of Google Analytics cookies is based on Art. 6 Para. 1 lit. f DSGVO. As the operator of this website, we have a legitimate interest in analysing user behaviour in order to optimise our website and, where applicable, advertising.

6 Which data is passed on to whom?

Dishnity does not forward users’ personal data to third parties unless the user has given his or her consent to do so, the transfer is required by law or is legally permissible.

6.1 General information on the transfer of personal data

User data and other data

Dishnity may pass on customer data to external service providers and agents who are commissioned to process customer data for the purpose of executing the contract (legal basis: Art. 28 DSGVO).

Customer data may be passed on in the context of changes to the business structure, legal regulations and the enforcement of Dishnity’s rights, to prevent fraud and to ensure security. Aggregated data or data adjusted for personal characteristics may be used for this purpose. Customer data is passed on to advertising partners and analysis and tracking services in pseodonymised form.

6.2 Categories of data recipients

The following categories of data recipients are possible or receive data from us:

  • Technical and hosting service providers
  • State authorities and courts
  • Advertising and distribution partners and cooperation partners
  • E-mail dispatch service providers and e-mail marketing service providers
  • Services to provide customer support
  • Affiliated companies
  • Other platform providers in the context of so-called “social plugins
  • Analysis and tracking services

6.3 Third countries

Data transfers to third countries take place, but only in compliance with the legally regulated conditions of admissibility. The data transfer to the following countries takes place in compliance with the respective legal admissibility requirements:

  • Israel (Adequate level of data protection recognised by EU Commission)
  • India (EU standard contractual clauses)

7 Which data is stored by Dishnity to ensure integrity and stability?

Personal data is used as follows to combat fake profiles, illegal activities (fraud, blackmail, prostitution, etc.), SPAM (third-party advertising) and to ensure the integrity and stability of the Dishnity platform:

  • IP and email addresses are stored to detect spam and illegal activities as long as the user is active.
  • Messages are automatically checked for keywords, but are not stored for this purpose.
  • Personal data such as gender, age and location are stored for active users and are used in combination with other, non-personal data to detect abnormalities.
  • To verify suspicious profiles via SMS, telephone numbers already used are stored, but cannot be linked to the verified user.
Legal basis

Dishnity bases the aforementioned data processing on Art. 6 I lit. f DSGVO. Dishnity has a legitimate interest in keeping its platform stable and free of SPAM, legal violations and fake profiles.

8 when are the data deleted and how are backups created?

All data collected from the user will be deleted or made anonymous when the user profile is deleted or we are notified of the deletion. The deletion can be initiated at any time directly within the Dishnity app under Settings. Alternatively, the user can request deletion by sending us a notification. The deletion of the Dishnity app alone does not cause the data to be deleted from Dishnity.

Due to legal regulations, for contract fulfillment or contract processing, the data which must be kept cannot be deleted. The following data will not be deleted immediately, but only after a period of time has elapsed:

  • For tax reasons: Payment data and data for premium redemption (after the legal retention periods have expired)
  • Data shared in chats with other users (e.g. messages or pictures). These are only deleted when both users have deleted each other.

If there is a suspicion that a user profile is being used in violation of the law or the contract, Dishnity reserves the right to review user data before deletion and to save it if necessary.

When will the deletion take place?

After deletion, the user profile is immediately no longer publicly accessible, i.e. it is deleted from the productive databases immediately. It can take up to 14 days until the deletion from all backups has taken place.

9 Which data security measures are there at Dishnity?

User data is extremely important to Dishnity. Dishnity uses suitable procedures to protect them and to protect them from unauthorized access: The use of the Dishnity domain and Dishnity app is carried out via a secure SSL/TLS connection. Thus, the communication between the user and our servers is encrypted.

10 What rights do the users of Dishnity have?

10.1 Consent and revocation

By registering with Dishnity, the user agrees that his personal data may be collected, stored and processed on the basis of this privacy policy and in accordance with the GTC. This consent is recorded by Dishnity during registration.

11 Update of Privacy Policy

This data protection declaration will be updated in the future if necessary, whereby the most current version, which can be accessed at https://rothech.com/dishnity-datenschutzerklaerung, always applies to the use of personal data.

If a substantial part of this statement is changed, the user will be notified via the e-mail address provided in the user profile. If the user continues to access Dishnity after an updated Privacy Policy has come into effect, the user agrees to be legally bound by the updated Privacy Policy.
